In December, 2012, the Minister of Human Resources and Skills Development announced that an electronic storage device, known as a USB key, containing the confidential personal information of 5,000 Canadians who applied for who had applied for pensions, old age security benefits, employment insurance or child care tax credits and other benefits went missing. 

The law firms of Sutts, Strosberg LLPCharney LawyersBranch MacMaster LLP and Bob Buckingham Law commenced a proposed class action against the Attorney General of Canada on behalf of all persons whose information was lost.

If you applied for pensions, old age security benefits, employment insurance or child care tax credits and other benefits, and were advised by Human Resources and Skills Development Canada that your confidential personal information was lost, you may be entitled to compensation. 

You may be entitled to compensation for the breach of privacy, damages for identity theft and/or damages to your credit reputation, damages for the costs incurred to prevent identity theft, damages for the time spent changing personal information such as your Social Insurance Number, damages for emotional distress/inconvenience, and/or compensation for out of pocket expenses.  Punitive damages will also be claimed because the Government failed to disclose the breach of privacy for at least one month.

We are strategically working on the CPP class action internally through our law firms and with government legal counsel.   The CPP class action lawsuit itself has been filed with the Federal Court of Canada.
